SUBJECT: THE UNLAWFUL APPOINTMENT OF THE SO CALLED MAYOR (CLR.TROMPIE RENIER) SPEAKER (CLR MARIUS BASSON) & MM (MONDE JANUARY) IN KAI ! GARIB

Following the ruling by the High Court of South Africa (Northern Cape Division) of 22 February 2023, on the matter between MEC of Co-operative Governance, Human Settlements and & Traditional Affairs, Department of Co-operative Governance, Human Settlements & Traditional Affairs and the Kai Garib Local Municipality, regarding the Special Council Meeting held on 08 February 2023.

The Honourable Mr Justice Nxumalo reserved justice thereafter on this day.

The court order that :

1) The motion be and is hereby deemed urgent and therefore the forms and services provided for by Uniform Rules of Court are dispensed with and the matter is disposed of urgently;

2) The special council meeting that was held on 8 February 2023 be and is hereby declared unlawful and invalid and is accordingly set aside;

3) Consequently, all the resolution taken at the said meeting are hereby declared void ab initio;

4) The cost of this application be borne by the Respondents personally; jointly and severally, the one paying the order to be absolved; such costs to be on an attorney and client scale.
